Terms and Conditions (T&C) of PaintingsCart

Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
- Withdrawal Period: The time period during which the consumer may exercise the right of withdrawal.
- Consumer: Any natural person acting for purposes outside their trade, business, or profession.
- Day: Calendar day.
- Durable Medium: Any medium that allows the consumer or trader to store information in a way that permits future reference and unchanged reproduction.
- Right of Withdrawal: The consumer’s right to withdraw from a distance contract within a specified period.
- Trader / Company: PaintingsCart.
- Distance Contract: Any agreement concluded exclusively through remote communication methods.
- Remote Communication: Means of concluding a contract without the simultaneous physical presence of the parties (e.g., website, email).
- T&C: These Terms and Conditions of PaintingsCart.

Article 3 – Scope of Application
These Terms and Conditions apply to all offers and distance contracts between PaintingsCart and consumers.
A copy of these Terms will be provided before the conclusion of any contract. If that is not possible, the consumer will be informed where the Terms can be accessed electronically.
Any deviations from these Terms apply only if they are more favorable to the consumer.
Invalid provisions do not affect the validity of the remaining Terms.
Any matters not expressly covered will be interpreted in the spirit of these Terms.
Article 4 – Offers
All offers are non-binding and subject to change.
Every offer includes a clear product description. Images correspond to actual products, though minor color variations may occur.
Each offer provides information about:
- The total price (excluding import VAT and customs duties payable by the customer);
- Shipping costs;
- How the contract is concluded;
- The right of withdrawal;
- Payment, delivery, and performance conditions;
- The validity period of the offer;
- The contract language (German or English);
- Complaints procedure;
- Return policy;
- Optional details such as sizes, materials, and colors.
Article 5 – Contract Formation
A contract is formed when the consumer accepts the offer and meets all related conditions.
Acceptance will be confirmed by email.
Payments and data transmissions are handled through secure connections.
PaintingsCart reserves the right to reject orders for legitimate reasons (e.g., suspected fraud, incomplete information).
Upon delivery, the consumer will receive:
- Contact details for customer support;
- Instructions on the right of withdrawal;
- Warranty terms;
- Information required under Article 4(3);
- Termination rules for ongoing contracts.
Article 6 – Right of Withdrawal ( ONLY VALID FOR EU )
Consumers may withdraw from the contract within 14 days after receiving the goods, without giving any reason.
Returned items must be unused and in their original packaging.
The withdrawal must be made in writing or by email within 14 days. The goods must then be returned within an additional 14 days.
Article 7 – Costs of Withdrawal
The consumer bears the cost of return shipping.
Refunds will be processed within 14 days after receipt of the withdrawal notice or proof of return.
Article 8 – Exclusion of Withdrawal
The right of withdrawal does not apply to:
- Custom-made or personalized products;
- Items unsealed for hygiene reasons;
- Digital products once download or streaming has begun;
- Perishable goods.
Article 9 – Prices
Prices are listed in USD and exclude import VAT and customs duties, which are payable by the recipient.
Typographical or pricing errors do not constitute a binding agreement. PaintingsCart is not liable for printing or display errors.
Article 10 – Warranty and Guarantee
Products comply with statutory quality standards.
Defects must be reported within 1 days of delivery. The product must be unused and in its original packaging.
Manufacturer warranties apply as stated by the producer. PaintingsCart is not liable for damages caused by:
- Unauthorized repair or modification;
- Improper use;
- Damage due to official regulations or inspections.
Article 11 – Delivery
Delivery will take place within 7-21 days, unless otherwise agreed.
If delivery is delayed, the consumer may cancel the contract free of charge.
Replacement products will be clearly marked as such. The consumer retains the right of withdrawal. In this case, PaintingsCart will cover the cost of return shipping.
The risk of loss or damage passes to the consumer upon receipt of the goods.
Article 12 – Contract Duration and Termination
Open-ended contracts may be terminated by either party with one month’s notice.
Fixed-term contracts end automatically upon expiry and will not renew without explicit prior consent.
Long-term contracts may be terminated after one year with one month’s notice.
Article 13 – Payment
Payment must be made within 2 working days after order confirmation.
The consumer must promptly report any incorrect payment or billing details.
In case of late payment, PaintingsCart reserves the right to charge reminder or processing fees.
Article 14 – Complaints
Complaints must be submitted in writing within 1 days of receiving the product.
A response will be provided within 14 days. If more time is needed, the consumer will be informed of the delay.
If a complaint is justified, PaintingsCart will offer a replacement or repair free of charge.
